I attach herewith files concerned with draft Proclamations for Hong Kong. The first drafts have been prepared by Mr. Hazlerigg and were sent to me some weeks ago. I have held them up, however, until a decision had been reached on various of the Malayan Proclamations.

I understand that now although the Malayan Proclamations have not yet

been officially agreed, they are unlikely to be altered further. I have had copies of the appropriate Malayan Proclamations registered on the same files as the draft Hong Kong Proclamations for reference, each of which is registered separately for easier reference. There are, however, a number

which have no Malayan counterpart.

I understand that Colonel Bacon, the War Office Legal Adviser, has suggested to the Hong Kong Planning Unit that, in order to prevent a possible last minute rush they should be considering with him the Hong Kong Proclamations now. Lt. Colonel Strickland of the Unit is seeing Colonel Bacon on Tuesday and will then discuss the matter with you. Meanwhile you may care to be studying these drafts.

I have obtained this and the files attached from Mr. Hastings in order to record that no action need be taken on the draft Proclamations submitted by Mr. Hazlerigg. (See 1). The Proclamations are now being re-drafted by the Hong Kong Unit (Colonel Strickland) in consultation with the War Office Legal Officer (Colonel Bacon). The present position is set out in Brigadier MacDougall's note of the 22nd August, which I have attached at (3).

I have attached the new draft Proclamations on "Offences against the Forces" and the new draft Proclamations "Military Courts" referred to in Brigadier MacDougall's note (3) to files 54145/8/3 and 54145/8/4 respectively.
